Congress funds DHS for one week in impasse on Amnesty

Agreeing on little else, Democrats and Republicans managed to come together late Friday to pass a short-term bill to keep the Homeland Security Department running one more week — though they made little headway on solving the underlying fight over President Obama’s deportation amnesty.

The funding bill will keep agents on the border, screeners at airports and grants flowing to states through March 19, averting a partial shutdown that would have struck at midnight. Mr. Obama signaled he would sign the bill, but it was unclear whether the extra week would do anything to break the impasse, which has now raged for three months….

Fifty five conservatives voted against the one-week bill, along with five Democrats. The conservatives argued that even a short-term bill would allow funding to flow to Mr. Obama’s deportation amnesty — the move that has prompted the entire funding dust-up.

House Republicans last month passed a bill to fund the Homeland Security Department for the rest of the fiscal year, but included language that blocks Mr. Obama’s November announcement of a program to grant legal status, work permits and Social Security numbers to as many as 4 million illegal immigrants.

Democrats argue Mr. Obama acted within his powers, and have generally defended him. They also said that fight should be separated from the homeland security spending fight.

Judge halts Obama’s deportation amnesty

A federal judge late Monday halted President Obama’s deportation amnesty, ruling he overstepped his powers in trying to grant legal status and “benefits and privileges” to millions of illegal immigrants, in a stunning decision that chides the president and throws the White House’s plans into disarray just a day before applications were to be accepted.

The White House said it will appeal Judge Andrew S. Hanen’s decision, but it’s unclear whether the case could reach the circuit court in New Orleans or even the Supreme Court before Wednesday, which is when the Homeland Security Department had planned to begin accepting the first applications under the new amnesty.

“The DHS was not given any ‘discretion by law’ to give 4.3 million removable aliens what the DHS itself labels as ‘legal presence,’ ” Judge Hanen wrote in issuing an injunction. “In fact, the law mandates that these illegally-present individuals be removed. The DHS has adopted a new rule that substantially changes both the status and employability of millions. These changes go beyond mere enforcement or even non-enforcement of this nation’s immigration scheme.”

In the immediate sense, the ruling will become a major part of the debate over homeland security funding that has roiled Capitol Hill, with Republicans insisting Mr. Obama’s actions were unconstitutional and should be halted through Congress’s spending power, and Democrats backing their president by filibustering to block funding for the Homeland Security Department altogether.

The ruling doesn’t mean those illegal immigrants are going to be deported immediately — indeed, Judge Hanen said they are likely not to be deported at all under Mr. Obama, who had set “priorities” putting them in little danger of ever being kicked out of the country, even without the formal amnesty.

The judge said Mr. Obama does have the right to set those priorities, but said it is likely a step too far for him to have set up a proactive program to grant them other benefits….

Obama announces amnesty for millions of illegal immigrants

Obama addressed the nation to outline a new executive order that will allow millions of illegal immigrants to remain in the country.

*New plan has enraged Republicans who say he lacks the constitutional authority to pick and choose which to deport.
*Illegal immigrants can’t apply for months and no one who arrived after January 1, 2010 is eligible.
*President acknowledges that it’s a temporary fix and demands help from Congress to make it permanent.
*Anyone who takes advantage of the program will have to pass criminal and national security background checks, pay their taxes, pay a fee and prove their eligibility.
*Two Republican aides complained about an ‘amnesty’ for people who came to the US illegally and then had children here – calling their children ‘anchor babies’.

President Obama announced a plan Thursday night to mainstream millions of illegal immigrants with an executive order allowing them to stay instead of facing deportation, bringing howls from Republicans who complained about so-called ‘anchor babies’ helping their illegal parents remain in the U.S.

The president calmly explained in a 16-minute speech – subtitled in Spanish – the parameters of what angry Republicans are calling a lawless ‘amnesty.’

‘We’re going to offer the following deal,’ he said: ‘If you’ve been in America for more than five years; if you have children who are American citizens or legal residents; if you register, pass a criminal background check, and you’re willing to pay your fair share of taxes – you’ll be able to apply to stay in this country temporarily, without fear of deportation.’

‘You can come out of the shadows and get right with the law.’

‘That’s what this deal is. Now let’s be clear about what it isn’t,’ the president cautioned.

‘This deal does not apply to anyone who has come to this country recently. It does not apply to anyone who might come to America illegally in the future. It does not grant citizenship, or the right to stay here permanently, or offer the same benefits that citizens receive – only Congress can do that.’

‘All we’re saying is we’re not going to deport you.’

Republicans pushed back immediately, with most of the energy coming from tea party conservatives.

‘Tonight President Obama issued an oral royal decree that will be followed by a written regal decree, as any good monarch would do,’ Texas Republican Rep. Louie Gohmert jabbed in a statement.

‘This unlawful, blatant executive action would legalize more than 5 million people here illegally. This president is single-handedly creating a constitutional crisis and hurting the citizens he took an oath to protect and defend.’

Utah Sen. Mike Lee, another tea party-linked lawmaker, called the president’s speech ‘a desperate attempt to remain relevant.’ The president has decided to defy the American people, ignore the election results, and usurp the legislative process,’ Lee said. ‘This act demonstrates he respects neither election outcomes, nor the rule of law.’

It will take the federal government several months to prepare for receiving applications. By that time, Republicans will control both houses of Congress and may take action to reverse the policy.

Obama Could Be Facing Deportation After What This Former DOJ Attorney Just Did

Throughout his presidency, Barack Obama has been hounded by one of the first nationwide scandals he ever faced. The authenticity of his birth certificate has repeatedly been called into question, leading critics to speculate that he is not a legitimate American citizen.

The debate has led to calls for his impeachment and prosecution; however, a former Department of Justice attorney recently initiated a push for an even bolder move: deportation.

Larry Klayman, who has gone on to establish the groups Judicial Watch and Freedom Watch following his time at the DOJ, filed a petition with the Department of Homeland Security’s Enforcement Removal Operations calling for Obama to be investigated.

“In sum,” he wrote, “deportation proceedings should be immediately commenced, an investigation undertaken, a full evidentiary hearing held, and Barack Hussein Obama should be removed from the United States.”

Klayman explained the reasoning behind his firm stance, alleging the president has “falsified various birth and other documents” ostensibly proving his citizenship and eligibility to hold his current office.

“It is clear,” the attorney continued, “based on a mountain of evidence as set forth in and attached to the petition, that the president and his agents have falsified documents, such as his birth certificate and Social Security number, to qualify for the privileges of American citizenship such that his citizenship, which is based on false pretenses, must be nullified.”

Klayman maintained that Obama has committed a crime regardless of his actual status by continually sticking to his argument that an obviously forged Hawaiian birth certificate is authentic….
